| Terms & Conditions All orders placed by customers with VertiGarden are accepted only on the understanding that the customer has read and fully understands the Terms & Conditions of Sale listed below- General The VertiGarden distribution is based in the UK Delivery to UK mainland customers ONLY Currency of transactions are in Pounds sterling ONLY Prices Due to our policy of continuous improvement, we reserve the right to alter prices and specifications without prior notice. All special offer items have been offered for sale at the higher price for a minimum 28 consecutive days. All prices are inclusive of VAT (where applicable). Delivery We will endeavour to complete delivery within 5-7 working days unless otherwise advised, but no liability can be accepted if circumstances prevent this. If we fail to deliver within the timescale advised, you may be entitled to a full refund. Claims for consequential losses arising from late delivery will not be accepted. Cancellation You can cancel an order and return any goods that may already have been dispatched up to 7 days from receipt (see return policy). Our terms and conditions do not affect your statutory rights. Returns Policy We will do our utmost to ensure that the product you receive is completely to your satisfaction and of the best quality possible. If; however, you are at all dis-satisfied with the product you receive, then you can return anything you're not happy with within 28 days of receiving it provided you have contacted us within 7 days of receipt. If notification is not made within 5 working days of the agreed delivery date, we will not be able to accept a claim for goods lost in transit. Damaged Goods/Missing Items All parcels must be checked prior to signing the delivery note. If there is any damage to products, or missing items, this must be advised on the delivery note and reported to VertiGarden within 3 working days. We reserve the right to reject claims for damaged and missing items if the above procedure is not followed. Faulty Goods Defective items will be replaced or refunded after inspection provided that we are notified in writing within 10 working days of delivery. Any warranty given will commence from the date of the invoice. Claims for faulty products will be limited to the value of the product, and no claims for any consequential loss arising from the use of faulty products will be accepted. Substitutions VertiGarden will endeavor to supply all plant varieties as offered however, we reserve to right to substitute with a similar variety of the same value should circumstances render the original variety unavailable. Incorrectly Ordered Goods Incorrectly ordered goods can be returned for credit providing that they are not soiled or damaged in any way, and that we are notified in writing within 10 working days of delivery. We will credit the value of the returned items less the cost of return carriage. No refunds or replacements will be considered until the original goods have been thoroughly inspected. Payment Terms Payment terms are payment in full by credit / debit card prior to despatch of order. Payments are in GBP ONLY Risk & Title Risk of damage to the goods supplied passes to the customer on delivery. Title to the goods shall not pass until VertiGarden has received in cash or cleared funds, payment in full for all monies due and outstanding for goods sold to the buyer. Consequential Loss VertiGarden accept no responsibility for loss of profits, incidental expenses or any consequential loss attributable to defects in material or delay in or non-delivery of goods.
